    BREEZE SITE TERMS AND CONDITIONS

    1 GENERAL

    1.1 Welcome to the Breeze site, www.everychild.co.tt (the “Breeze Site”). The Breeze site is provided by Unilever Plc, a company registered under number 0041424 in England and whose registered office is at Port Sunlight, Wirral, Merseyside CH62 4ZD (“Unilever”).

    1.2 By submitting content and accessing this site, you agree to be bound by these terms and conditions. These terms and conditions should be read in conjunction with the Unilever Privacy Policy.

    2 VARIATIONS

    2.1 Unilever may from time to time vary these terms and conditions. Please check these terms and conditions regularly to ensure you are aware of any variations made by us. If you continue to use the Breeze Site, you are deemed to have accepted such variations. If you do not agree to such variations, you should not use the Breeze Site.

    3 YOUR CONTENT

    3.1 When submitting content, text and other data to the Breeze Site (“Content”), you confirm that all Content:

    3.1.1 was created by you and is original to you;

    3.1.2 has not previously been removed from the Breeze Site or any other website;

    3.1.3 does not contain any personal information which identifies any individual relating to any persons under 18, irrespective of whether you are their parent or guardian

    3.1.4 does not infringe any other person’s rights;

    3.1.5 does not contain any material which is or is likely to be offensive, indecent, unlawful, obscene, sexually explicit, drug or criminal-related, defamatory, blasphemous, degrading or otherwise unacceptable content;

    3.1.6 does not constitute or contain any advertisement or promotion for any product, service or brand;

    3.1.7 does not advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse;

    3.1.8 does not contain any falsehoods or representations that may damage Breeze, any persons featured in the image or any third party;

    3.1.9 does not constitute, encourage or display any bullying, violent, abusive, discriminatory or threatening behaviour or harassment of any person;

    3.1.10 does not, and is not likely to, give rise to civil or other liability; and

    3.1.11 does not contain any viruses, worms, ‘spyware’ or other components or contaminants which may have the ability to adversely affect, or in any way damage, copy, relay, modify or delete, any software, the Breeze Site, any information or any hardware.

    4 USE OF CONTENT

    4.1 If Unilever notifies you that you are prohibited from submitting any further content you will immediately and permanently desist from doing so and will not authorise a third party to submit further Content on your behalf.

    4.2 Unilever reserves the right to submit copies of any Content (and any data which is held in relation to you) which Unilever considers to be illegal, offensive or otherwise of significant concern to the appropriate regulatory authorities.

    4.3 Unilever will endeavour to preview all of your Content before it is posted onto the Breeze Site, and Unilever reserves the right to monitor any information transmitted or received through the Breeze Site.

    4.4 Unilever reserves the right to reject, edit, block, suspend or remove your Content at any time and in its sole discretion without reverting to you. Unilever in no way guarantees that your Content or any part of it will be displayed on the Breeze Site.

    5 ACCESSING THE BREEZE SITE

    5.1 Access to the Breeze Site is permitted on a temporary basis and Unilever reserves the right to withdraw or amend the service without notice. You are responsible for making all arrangements necessary to access the Breeze Site. You are also responsible for ensuring that all persons accessing the Breeze Site through your internet connection are aware of these Terms and Conditions. In particular, you are responsible for supervising anyone who is under 16 when using the Breeze Site.

    6 THIRD PARTY SITES AND CONTENT

    6.1 The Breeze Site and/or the materials and downloadable content contained on the Breeze Site may contain links to third party sites. If you decide to visit any third party site which is linked from the Breeze Site, you do so at your own risk. Unilever are not responsible for the content, accuracy or opinions expressed in any such third party sites. Links do not imply that Unilever or the Breeze Site is affiliated to or associated with such third party sites.

    6.2 Your browsing and interaction on any other site, including sites which have a link to the Breeze Site, is subject to that sites own rules and policies. Please read over those rules and policies before proceeding.

    7 INTELLECTUAL PROPERTY

    7.1 You may access, view and print out one copy of the Breeze Site and all information, images, and other content displayed on the Breeze Site ("Materials"), on a single device strictly in accordance with these terms and conditions.

    7.2 You may only view, print out and use the Breeze Site and the Materials for your own personal, non-commercial use. Unilever expressly reserves all intellectual property rights in and to the Breeze Site and the Materials and your use of the Breeze Site and Materials is subject to the following restrictions. You must not:

    7.2.1 remove any copyright or other proprietary notices contained in the Materials;

    7.2.2 copyright, intellectual property right, proprietary right, or property right of Unilever or any third parties; or

    7.2.3 reproduce other than for personal individual use, modify, display, perform, publish, distribute, disseminate, broadcast, frame, communicate to the public or circulate to any third party or exploit the Breeze Site and/or the Materials in any way including for any commercial purpose, without Unilever’s prior written consent.

    8 LICENCE

    8.1 By submitting the Content you grant Unilever and third parties acting on its behalf a perpetual and irrevocable, worldwide, non-exclusive, royalty free licence to use, reproduce, display, adapt, distribute and promote the Content in any form in all media now known or hereinafter created, anywhere in the world and for any purpose.

    9 RELIANCE ON INFORMATION POSTED

    9.1 Materials posted on the Breeze Site, including by way of example only the views of “experts” and the view of other parents are not intended as advice and should not be relied upon as such. Unilever therefore disclaims all liability and responsibility arising from any reliance placed on any information to the maximum extent permitted by law. Information, opinions and ideas on the Breeze Site are provided as suggestions and to offer inspiration only and should not be taken as advice. Before encouraging your child to undertake any suggested activities, please bear in mind your child’s particular skills, circumstances and level of development – all children are different and what may be suitable for some children will not be suitable for others. You should supervise you child while they undertake any of the activities inspired or suggested by this Breeze Site. ALWAYS SUPERVISE YOUR CHILD WHEN THEY ARE, OR COULD BE, USING ANY POTENTIALLY DANGEROUS EQUIPMENT, MATERIALS OR SUBSTANCES. Unilever cannot be held responsible for any accidents or incidents of any kind which result from participation in the activities suggested on the Breeze Site or from use (whether supervised or not) of potentially dangerous equipment, materials or substances.

    10 LIABILITY

    10.1 Unilever shall not be liable, under these terms and conditions or otherwise for any indirect, special, incidental or consequential damages or otherwise, even if advised of the possibility of such damages.

    10.2 The Breeze Site may contain inaccuracies and typographical errors. Unilever does not warrant the accuracy or completeness of the materials found on the Breeze Site.

    10.3 Unilever shall not be liable for any loss or damage caused as a result of your actions or inactions based on the materials available on the Breeze. However, nothing in these terms and conditions shall affect your statutory rights, and nothing in these terms and conditions shall exclude Unilever’s liability for:

    10.3.1 death or personal injury arising through our negligence;

    10.3.2 fraudulent misrepresentation; or

    10.3.3 anything else that cannot be excluded or limited by us under English law.

    10.4 You hereby indemnify (and shall keep indemnified) and hold harmless Unilever, its directors, employees, agents and representatives against any claim, loss, expense, liability or damages suffered by Unilever resulting from the use of your Content or your breach of these terms and conditions.

    11 JURISDICTION AND GOVERNING LAW

    11.1 These terms and conditions are governed by English Law and any disputes arising in relation to these terms and condition shall be subject to the non-exclusive jurisdiction of the English courts.
